Wealth Transfers Worries - Temecula/Murrieta Estate Planning Blog

Younger members of ultra-wealthy households are grappling with their forebears for a say in wealth planning, and women are concerned about how money affects their relationships, the study found, after surveying 53 families with a net worth of $100 million or more earlier this year.?

Planning your wealth transfer can be complicated. While there are many elements to consider, forgetting the ?family factor? could be detrimental.

Obscure laws, politics, budgets, financial markets, returns, etc., are all important elements of wealth transfer. Unfortunately, for many planners, it?s a sad irony that they oftentimes overlook the true object of the process ? the inheritors. So, how do inheritors factor into planning?

Financial Planning magazine recently weighed in on this issue with an article titled, ?Younger Inheritors, Women Concerned About Pitfalls of Wealth.? The article featured the results of a new survey by Campden Wealth and Morgan Stanley Private Wealth Management. This survey examined multiple generations within high-net worth families for their opinions on their family estates and their roles in planning for the future. The results are telling.

79% of next-generation inheritors responded that they wanted to be good stewards of the family wealth. In fact, they want more involvement in the finances. Although these respondents diverged regarding what they would do with the investments, most were enthusiastic.

It?s clear that families planning for wealth transfers should consider bringing the inheritors to the table sooner rather than later. The educational opportunity is profound when an interest is present.

Interestingly, 79% of female inheritors indicated concern over how the impact might affect them. They also expressed concern over potential mismanagement of wealth outside of their control. Education is certainly essential regardless of gender, but perhaps more so for females. Traditional stereotypes still remain relevant.

In either case, the biggest takeaway from the original article is this: today?s inheritors are eager for information and inclusion.

Whether your estate is monstrous or modest, when it comes to the ultimate inheritors, a little foreknowledge will go a long way toward ensuring the success of your wealth transfer.

Report: State tobacco prevention funding lacking

(AP) ? States have spent only about 3 percent of the billions they've received in tobacco taxes and legal settlements over the last decade to fund tobacco prevention programs, making it harder to reduce the death and disease caused by tobacco use, according to a report released Thursday by the federal Centers for Disease Control and Prevention.

Between 1998 and 2010, states have collected nearly $244 billion in cigarette taxes and settlement money, compared with only $8.1 billion earmarked for state tobacco control efforts. The numbers are far less than the minimum of $29.2 billion the CDC said should have been spent over that same period.

While states on average have never spent as much the CDC would like, the total has declined dramatically in recent years as states grapple with budget deficits that have forced layoffs, furloughs and cuts for basic services. Many also have raised tobacco taxes in order to increase revenue and supplement funds provided by the tobacco industry.

About 46 million Americans smoke, while more than 3 percent of American adults use smokeless tobacco, according to the CDC. And tobacco-related diseases are responsible for about 443,000 deaths a year in the U.S. If states were to use a greater portion of the tax and settlement money for tobacco control and prevention programs, they could achieve larger, more rapid reductions in tobacco use and health-care costs, as well as lower tobacco-related death and disease, the report said.

"We understand that there are severe financial pressures and that they have difficult choices to make," CDC Director Dr. Thomas Frieden said in a telephone interview with The Associated Press. "Not investing in tobacco control is not only penny wise and pound foolish, but it's also costing lives."

According to the report, states that have spent larger amounts on tobacco control programs have seen cigarette sales fall about twice as much as in the U.S. overall. Smoking prevalence also has declined faster as anti-tobacco spending increased in states like Arizona, California, Massachusetts, Minnesota, Maine, New York, Oregon and Washington, the report said. However, other factors like smoking bans also could have contributed to those reductions.

Frieden said that while states are lacking in prevention funding, tobacco companies continue to spend billions on marketing. The industry spent $10.5 billion to market their products in 2008, the most recent year tracked by the Federal Trade Commission. In that same year, state anti-tobacco funding was about $779 million, according to the report.

"The tobacco companies are out there doing everything they can do, and they have gobs of money to do it," said Stanton Glantz, a tobacco researcher who directs the Center for Tobacco Control Research and Education at the University of California, San Francisco.

"You don't need to meet them dollar for dollar, you just need to be out there with enough to counter them. ... It's easier to sell the truth than a lie."

In addition to raising tobacco taxes from an average of 39 cents per pack in 1998 to $1.44 per pack in 2010, states continue to receive millions of dollars every year from the tobacco industry in the form of a long-standing legal settlement.

Tobacco companies agreed in 1998 to settle lawsuits several states brought over smoking-related health care costs by paying them about $206 billion over more than two decades, but the settlement did not require the money be used for anti-tobacco and stop smoking programs. States first received full payments under the settlement in 1999. The largest U.S. tobacco company, Altria Group Inc. ? based in Richmond, Va., and maker of Skoal smokeless tobacco and top-selling Marlboro cigarettes ? pays a majority of that.

"Today, there's more tobacco-generated revenue available to the states, as well as the federal government, than ever before to fund proven efforts that can prevent underage tobacco use," said Altria spokesman Ken Garcia. "Obviously there's a large spend opportunity to put toward these programs that will help further reduce underage tobacco use and promote cessation."

HOW TO DELIVER A GOOD LECTURE

The Four Aspects of an Effective Lecture

The lecture is still the most frequently used method of instruction.?

Even if you are not a teacher, in your everyday work you may be constantly using the medium of speech to convey a message or instruction or for informal training or motivational purposes.?

How well you put across your ideas depends to a large extent on now well you have mastered the elements of good public speaking.

An important pre-requisite of a good lecture is that it must be carefully prepared to the extent that you have a firm mastery of the topic you are going to discuss and a clear conception in your mind of how you are going to present the subject.

A good lecture has four simple requirements:

1.?MESSAGE

The first characteristic of a good lecture is that it must have a message. The lecturer must have something to say and what the lecturer says must be worth saying and worth listening to.?

You must clearly bring out the importance of the topic and why the audience needs to hear you and unambiguously state your message so that the audience understands what you want to say.

You may have heard Aristotle?s dictum on?rhetoric:

"Tell them what you are going to say,?say it,?and then tell them what you told them."

So, to get your message across, thus is what you must do:

1. Tell the audience what you are going to tell them

2. Tell them what you want to tell them

3. Tell them what you have told them

2.?NATURALNESS

The second attribute of a good talk is naturalness.?

Remember, the audience wants to hear?YOU?so make it your own lecture, your very own talk ? speak in your very own natural style, don?t try to copy someone else.

3.?SINCERITY

The third feature of an effective lecture is that it must be sincere.?

The audience must be convinced that you believe in what you say, so make sure you talk sincerely and clearly demonstrate that you believe in what you are saying.?

Remember, you cannot fake sincerity so the only way to succeed in giving an impression of sincerity is to be sincere. Don't try to ham, act or pretend - the audience will easily catch on that you do not yourself believe in what you are saying.?

And suppose you do not believe in something or are not fully convinced about a topic.?

Well, why talk about something you do not believe in??

As a Teacher or Speaker you must be true to your conscience and you must not live a lie and say something you do not believe in.?

Remember the saying of Mahatma Gandhi:

What you?think,?

what you?say,?

and what you?do?

must be in?harmony.

This must be evident to the audience.

4.?ENTHUSIASM

Finally, last but not the least, a good lecturer or speaker must radiate enthusiasm and energy.?

An enthusiastic speaker is one who displays great eagerness to have his or her ideas understood, believed and put into practice.?

You should be passionate about what you are speaking about and you must yourself believe in what you are saying.?

If you want your audience to be enthusiastic about listening to you, radiate enthusiasm yourself while speaking.

So, in a nutshell, before you deliver your next lecture, keep these basic four principles in mind (message,?naturalness,?sincerity,?enthusiasm) and you will deliver a great lecture ? you can take my word for it.

A sunny, warm May day was made all the brighter in Montrose with the return of the annual Chocolate & Wine Festival.

The festival, now in its fifth year, has grown since its inception, added new events and features top-notch entertainment.

Organizer Tom Follert estimated about 3,300 people attended this year?s event ? beating out attendance of previous years.

In its inaugural debut, nine contenders vied for the Barbecue Cook-off title.

Team T-Rex?s Ribs, representing EMHS and headed up by CEO Rex Caztlin, took the trophy and $700 prize money.

The winnings were immediately donated to the Cabot-EMHS Community Challenge matching fund program ? netting the new hospital building project $1400.

Lucky winner of the handstitched ?Chocolate? quilt was Patricia Follert.

Susquehanna County?s Hidden Creek Vineyard & Winery servers pour a sample taste into Chocolate & Wine Festival commemorative wine glasses.

Eleven Pennsylvania wineries, as well as 70-plus vendors provided festival goers with food, drink and one-of-a-kind merchandise.

On the Chocolate & Wine stage, theBaltimorearea Kelly Bell Band headlined the entertainment lineup that also featured The Scott Weis Band, Jake Lear and local favorite, The Lonnie Griffiths Band.

Around Montrose, the juried art exhibit, ?focus,? opened at the Butternut Gallery & Second Story Books. The exhibit will remain on display through June 2. Votes can still be cast for the ?People?s Choice? award.

Hill Country Artists held an art show and sale in the former Montrose Country Store building ? which is also where hourly tours of the Chocolate Factory started.

Police hold diamond-swallower until evidence moves

(AP) ? Police in the Canadian province of Ontario say they are holding a man who allegedly swallowed a $20,000 diamond as long as it takes for him to produce the evidence.

It has been nearly a week since Richard Mackenzie Matthews, 52, is alleged to have switched a diamond at Precision Jewellers and swallowed the real one.

Matthews has been held at police headquarters while they wait for the 1.7-carat stone to pass through his system. Sgt. Brett Corey said Thursday that Matthews has gone to the washroom numerous times, but the diamond hasn't passed.

Corey says a recent X-ray showed a pair of fake diamonds, or cubic zirconiums, stuck in the man's intestines but because a diamond is translucent, it isn't visible. He says the suspect is eager to get the ordeal over with and is co-operating.

In the early stages, Corey says Matthews was being given laxative type foods, but is now being fed whatever he wants, in an effort to get things moving.

Matthews is charged with theft and breach of court conditions, and is also wanted on warrants in Toronto.

London's red telephone boxes are iconic, sure, but just how relevant can they be in this century? Spectrum Interactive has a solution that both ensures their preservation and provides customers in search of internet a free ticket online. The company has converted some 1,800 pay phones throughout London into WiFi hotspots, offering passersby a free connection so long as they provide their mobile numbers and download an e-coupon for a nearby store. Spectrum initially began testing the program with the help of Nokia late last year, and while it's amassed an impressive number of WiFi access points, it's lost the support of its Finnish partner, and is still assessing how willing local businesses are to pay for getting coupons in the service. On top of that, there's the whole issue of how many people will think to scope out phone booths rather than, say, an internet cafe. Here's hoping Spectrum has some very flashy signs on the windows.

University of British Columbia researchers have found a potential way to develop universal flu vaccines and eliminate the need for seasonal flu vaccinations.

Each year, seasonal influenza causes serious illnesses in three to five million people and 200,000 to 500,000 deaths. The 2009 H1N1 pandemic killed more than 14,000 people worldwide. Meanwhile, public health and bioterrorism concerns are heightened by new mutations of the H5N1 "bird flu" virus, published last week by the journal Nature, that could facilitate infection among mammals and humans.

Led by Prof. John Schrader, Canada Research Chair in Immunology and director of UBC's Biomedical Research Centre, the research team found that the 2009 H1N1 "swine flu" vaccine triggers antibodies that protect against many influenza viruses, including the lethal avian H5N1 "bird flu" strain.

Details are published today in the journal Frontiers in Immunology.

"The flu virus has a protein called hemagglutinin, or HA for short. This protein is like a flower with a head and a stem," says Schrader, a professor in Medicine and Pathology and Laboratory Medicine. "The flu virus binds to human cells via the head of the HA, much like a socket and plug.

"Current flu vaccines target the head of the HA to prevent infections, but because the flu virus mutates very quickly, this part of the HA changes rapidly, hence the need for different vaccines every flu season."

Vaccines contain bits of weak or dead germs that prompt the human immune system to produce antibodies that circulate in the blood to kill those specific germs. However, the research team found that the 2009 pandemic H1N1 vaccine induced broadly protective antibodies capable of fighting different variants of the flu virus.

"This is because, rather than attacking the variable head of the HA, the antibodies attacked the stem of the HA, neutralizing the flu virus," says Schrader. "The stem plays such an integral role in penetrating the cell that it cannot change between different variants of the flu virus."

The new discovery could pave the way to developing universal flu vaccines.

Schrader says the characteristics of the human immune system make it difficult for influenza vaccines to induce broadly protective antibodies against the HA stem. "The pandemic H1N1 swine flu was different, because humans had not been exposed to a similar virus," he adds.

Schrader has evidence that a vaccine based on a mixture of influenza viruses not circulating in humans but in animals should have the same effect and potentially make influenza pandemics and seasonal influenza a thing of the past.

HBT: Willis drops grievance, will rejoin Orioles

A couple of weeks ago, Dontrelle Willis left the Orioles. He says he did so with permission. The Orioles said he was AWOL. ?The team put him on the restricted list. Willis filed a grievance and his agent went off on the Orioles. ?That relationship looked to be over.

But cooler heads have prevailed: Jerry Crasnick reports that Willis has dropped his grievance and will rejoin the team.

The apparent reason: the Orioles are going to let him try starting. ?Word at the time was that Willis left the team for the precise reason that he wanted to start, not be a relief pitcher. Never mind that most people figure that the only shot Willis has of keeping a job in baseball now is as a lefty specialist.

So, peace in our time. I suspect that Willis is going to regret getting what he asked for, but at least everyone has stopped bickering.
