Jennifer Lopez unsure on marrying again (Reuters)

(Reuters) ? Three-times married Jennifer Lopez said on Monday she doesn't know if she'll wed again after splitting up with her Latin pop singer husband Marc Anthony last year.

"Let's see, I don't know. It's not time to think about that yet, do you know what I mean? Like, it's still fresh," the singer and "American Idol" judge told Matt Lauer on TV talk show "Today."

Lopez, 42, who split with Anthony in July after seven years marriage and two children, also fielded questions regarding comments she made about her divorce in an interview with Vanity Fair magazine last August, when she said "I love myself enough to walk away" from her marriage with Anthony.

"Everything I wanted to say about the divorce I said in that article, and Marc and I agreed that we weren't going to talk about it publicly again," said Lopez.

"We're human and it's not the easiest thing in the world but I think we handled it with a lot of grace and a lot of caring and a lot of love," she added

The "On The Floor" singer teamed up with her ex-husband on their "passion project," new talent show "Q'Viva! The Chosen," to find the best artists from Latin America for a stage show in Las Vegas. "Q'Viva" debuted on Saturday on Univision and on 20 other TV networks in Central and South America.

Suspect in Iran missile plot to appeal to EU court (AP)

LONDON ? Lawyers for a retired British businessman accused of plotting to sell missile components to Iran said Tuesday that he will ask European Courts to rule on his appeal against being extradited to the United States.

Christopher Tappin, 64, faces charges in Texas over allegations that he offered in 2006 to sell specialized batteries for Hawk missiles for $25,000. He didn't know then that his contacts were undercover U.S. agents, not Iranians, U.S. authorities say. Two other men have been jailed in Texas in the case.

Tappin faces up to 35 years in jail if convicted in the United States, but he denies the charges and says he was the victim of a sting operation.

He has unsuccessfully fought his extradition in Britain, where a judge ruled against him last year and two High Court judges said Tuesday that he lacked the legal basis to take his fight to the U.K. Supreme Court.

Lawyer Karen Todner said Tappin will instead lodge an application with the European Court of Human Rights in Strasbourg, France, within a few days, and will ask the court to halt extradition proceedings until his case is heard.

Another Tappin lawyer, Edward Fitzgerald, had argued that under European human rights legislation, Tappin should not be extradited because he had to care for his sick wife.

U.K. judges have ruled that the severity of the charges against Tappin outweighed his right to not be extradited, but Todner said that the British government had agreed not to begin extradition proceedings for 14 days, to give Tappin time to lodge the European appeal.

Tappin's case is the latest to expose trans-Atlantic tensions over the exchange of criminal suspects.

Lawyers complain that under "fast track" extradition procedures introduced after the Sept. 11, 2001, attacks, the U.S. is not required to offer substantial proof of an allegation when seeking to extradite a suspect from Britain.

But in October 2011, a judge-led review in the U.K. found that extradition agreements between the United States and Britain are fair and unbiased.

Police: No evidence to support Maine tot abduction (AP)

WATERVILLE, Maine ? Police who confirmed the discovery of blood from a missing toddler in the basement of her father's home said Monday they've found no evidence to support an abduction, and they believe adults in the home know more than what they're telling investigators.

Six weeks after Ayla Reynold's disappearance in Waterville, state and local detectives believe the father, Justin DiPietro, and two other adults in the home on the night Ayla was last seen are not giving a full account of what happened, said Steve McCausland, spokesman for the Maine Department of Public Safety.

The idea that someone sneaked into the small house and took Ayla without awakening any of the adults "doesn't pass the straight-face test," McCausland said.

"We've followed every conceivable piece of evidence that would follow their version of events, and we have found not one piece of evidence that supports an abduction," he said Monday.

Ayla was 20 months old when she disappeared on the night of Dec. 16. She had been staying with her father at the time in the house where DiPietro lives with his mother. Ayla's mother, Trista Reynolds, lives in Portland.

DiPietro reported Ayla missing the following day. He'd put her to bed the night before and said she wasn't there the next morning.

Over the weekend, state police confirmed that blood was found in the basement where the father slept and that some of the blood was Ayla's. Relatives reported on a family-run website that they were told the blood was "more than a small cut would produce" but police declined Monday to say how much blood was discovered.

On the night Ayla was last seen, DiPietro was in the home with his girlfriend, Courtney Roberts, and they slept with Roberts' child in the partially finished basement where the blood was found, McCausland said. DiPietro's sister was sleeping with her young child on the main level of the one-story home, and Ayla was in a bedroom by herself on the main level, McCausland said Monday. DiPietro's mother was not home that night.

Trista Reynolds' father said the family was told late Saturday by McCausland that blood found in the home was determined to be Ayla's.

"It was a surprise," Ronald Reynolds said.

He said police didn't give any indication what the discovery means.

Ronald Reynolds said he is convinced the adults in DiPietro's house have more information than they have shared.

"Every day, it gets hotter and hotter," he said. "I hope they pull them back in, set them down and give them the opportunity to say something."

The family-run website issued an appeal for anyone with information about Ayla to come forward.

"Even in light of this evidence we are more determined than ever to find out what has happened to Ayla and we still cling to the hope that she is alive and will be returned to us," the website said. "We urge anyone that has information about Ayla to come forward now and unburden yourself of the truth."

Japan's industrial output rebounds 4 percent (AP)

TOKYO ? Japan's industrial production rebounded 4 percent in December from November and household spending increased for a second month, suggesting the still-weak economy is gaining some steam after last year's tsunami disaster and flooding in Thailand that disrupted manufacturers' supply chains.

Output of automobiles, cell phones and semiconductors drove the gains last month after production fell 2.7 percent in November. Manufacturers project further production increases in January and February, the Ministry of Economy, Trade and Industry said Tuesday.

But Japan's unemployment rate edged up to 4.6 percent and Junko Nishioka, economist at RBS Japan Securities, cautioned that the economic outlook was "mixed."

While she was heartened by the 0.5 percent uptick in family spending, Nishioka said prospects for Japan's vital manufacturing sector remained tentative amid weak export demand.

"The pace of recovery will be slow," she said. "So far, we're seeing some recovery in the auto sector and electronic components, but still it's still not enough to compensate for the gap recorded after the March disaster and the Thai flooding."

The factory data showed that shipments grew 4.5 percent and inventories fell 2.9 percent, both healthy indicators. Broadly speaking, production was led by strength in the electronics, automobile and general machinery sectors, the report showed.

Looking ahead, manufacturers predicted that industrial output would rise 2.5 percent in January and another 1.2 percent in February, according to a METI survey.

PFT: Irsay seeks to avoid 'sentimental' decision

103381900-e1327598113103Getty Images

It?s official.? In Saturday?s edition of the Cleveland Plain Dealer, ?reader representative? Ted Diadiun addressed at length the decision to remove long-time Browns writer Tony Grossi from the team?s beat.? Diadiun?s article is well-written, superficially persuasive, and apparently effective, given the number of emails we?ve received from folks who believe based on Diadiun?s article that the newspaper did the right thing.

But it doesn?t change our opinion that the Plain Dealer cowered to the Browns.? In fact, it strengthens it.

When scrutinizing an employment decision, inconsistencies in the reasons and rationalizations from the employer become extremely important.? The thinking is that, if the employer can?t tell a unified story in support of a supposedly legitimate decision, it?s possible that the employer is trying to conceal potentially illegitimate motives.? Circumstantial evidence also takes on a critical role, since the employer rarely will admit to ordering the Code Red.? Or, perhaps for these purposes, a Code Orange.

And that?s really the ultimate question.? Did the Browns order a Code Orange on Grossi?? Or, more accurately, did the Plain Dealer reassign Grossi because it believed the Browns wanted Grossi out?

Let?s consider the facts, the circumstances, and the inconsistencies.

First, the facts.? Grossi posted on his Twitter page a message that he had intended to keep private.? In the message, Grossi called Browns owner Randy Lerner a ?pathetic figure? and ?the most irrelevant billionaire in the world.?? (Of all the billionaires in the world, technically one of them must be the most irrelevant.)? Grossi immediately deleted the tweet once he realized his mistake.? By then, however, his words had been copied and repeated across the Internet, and it was impossible to unring the bell.

Grossi apologized publicly, the Plain Dealer apologized publicly, and Plain Dealer publisher Terrance C.Z. Egger sent a written apology to the Browns and to Lerner.

Though not addressed in Diadiun?s column, the Browns responded with silence.? Apart from declining to comment in response to inquiries from PFT, the Browns and Lerner refused to take calls from Grossi, and possibly from other officials of the Plain Dealer.? Indeed, Diadiun admits that ?[n]one of the editors involved talked with anyone connected with the team? before making the decision to reassign Grossi.

Diadiun omits reference to the key question of whether the Plain Dealer tried to have such discussions.

Second, the circumstances.? Most significantly, Diadiun admits that Egger personally met with Lerner and team president Mike Holmgren on Wednesday, after the decision was made to reassign Grossi.? The fact that a meeting occurred invites speculation that the Browns cared ? or at a minimum that the Plain Dealer believed the Browns cared ? about the manner in which this situation was handled.

Third, the inconsistencies.? On Thursday, Plain Dealer managing editor Thom Fladung told 92.3 The Fan in Cleveland that the ?determining factor? for the decision was the following standard:? ?Don?t do something that affects your value as a journalist or the value of your newspaper or affects the perception of your value and the perception of that newspaper?s value.?? Fladung also said that Grossi?s opinions would have been permissible if he had posted them not on his Twitter page, but in the pages of the Plain Dealer.? ?Let?s say Tony had written that Randy Lerner?s lack of involvement with the Browns and their resulting disappointing records over the years has made him irrelevant as an owner, that?s defensible,? Fladung said.? ?That?s absolutely defensible.?

But Diadiun?s item contains a contradictory quote from Plain Dealer editor Adam Simmons, who thinks that Grossi?s role as a beat writer precluded him from making the statements about Lerner in any context.? ?If it had been a columnist who wrote that, we might cringe, but that role is different,? Simmons said. ?They?re paid to offer up opinions, however prickly. But we?re not asking them to go out and cover a team in a fair and balanced and objective way, like we are with a reporter.?? (Presumably, Simmons also believes that a columnist could have offered those opinions on his Twitter page, since opinions are fair game for a columnist.)

Complicating matters is Diadiun?s attempt to reconcile the action against Grossi with his First Amendment rights.? Rather that relying on the simple ? and accurate ? notion that employees of a private, for-profit enterprise have no First Amendment rights, Diadiun draws a clumsy line between personal and professional social media.? ?Anyone who works at the paper has the right to say, write or Tweet anything they wish,? Diadiun writes.? ?But they do not have a corresponding right to say it in the newspaper or on the website or on their newspaper Twitter account.? If they do, the editors who are in charge of maintaining the credibility of the newspaper have the right to change their assignment.?

So Fladung says that Grossi could have said what he said in the paper, Simmons says that Grossi couldn?t have said what he said anywhere unless he was a columnist, and Diadiun says that Grossi could have said what he said on his own, personal Twitter page.? And no one says it?s impermissible for Grossi to secretly possess those views, even if those views (as Diadiun writes) undermine his credibility.? Under the newspaper?s view of journalistic ethics, it only becomes a problem when those views are disclosed ? which actually should make Grossi even more credible, since he has openly acknowledged his bias.

The end result is a stew of mixed messages, which invites speculation that the real reason for the move was to maintain a good relationship with the Browns.? Though there continues to be ? and likely never will be ? any evidence that the Browns told the Plain Dealer what the Browns wanted the Plain Dealer to do, some of the loudest and clearest messages can be sent through silence.

When Grossi or others from the Plain Dealer tried to call Lerner and/or Holmgren and they refused to speak, what should a reasonable person conclude?? Moreover, why would a meeting with Lerner and Holmgren even be needed if the Plain Dealer didn?t care about the team?s response to the situation?? If this decision was solely about journalistic standards and the integrity and credibility of Grossi?s coverage in the eyes of the audience given his personal views regarding Lerner, there was no reason to go to Berea and kiss rings and/or smooch butts.

That?s the fundamental disconnect.? The Plain Dealer wants us to believe it engaged in a textbook exercise in ethics while at the same time doing things like writing letters of apology to Lerner and publicly calling Grossi?s words about Lerner insulting and personally meeting with Lerner and Holmgren.

Though the Browns may not have intended to order a Code Orange, we believe that the Plain Dealer believed that it needed to remove Grossi from the beat in order to remain in the good graces of the Browns.? And we?d have far more (or, as the case may be, any) respect for this decision if the Plain Dealer would simply admit that which upon inspection of the facts, the circumstances, and the inconsistencies seems obvious.

Sergio Mendes says 'Rio' sequel likely (AP)

NEW YORK ? Sergio Mendes, who scored an Oscar nomination for his song "Real In Rio," says the animated film will most likely have a sequel.

Mendes said "Rio" director Carlos Saldanha may want to tie the sequel to the 2014 World Cup, which will take place in Brazil.

"I think the plan is for the movie to come three or four months before the World Cup," Mendes said Tuesday afternoon.

"Fox has been talking about (it) and it looks like it's going to happen," he continued. "We're going to have a meeting I think next week and Carlos is coming to town to tell us the story, and it looks like it's a go."

Fox didn't immediately respond to an email request seeking comment on the possibility of a sequel.

Mendes and Saldanha are from Brazil. Mendes said creating music for the film ? about birds adventuring to Rio de Janeiro with the voices of Jesse Eisenberg and Anne Hathaway ? was special "because that's my hometown."

Mendes shares his nomination with Siedah Garrett and Carlinhos Brown. He said he's not feeling pressure to create new music for the "Rio" sequel following his Oscar nod.

"I take one thing at a time," he said. "Right now I'm celebrating."

Fed and Apple restart Wall Street's advance (Reuters)

NEW YORK (Reuters) ? Big profits from Apple and a promise from the Federal Reserve to keep rock-bottom rates for at least two more years powered the U.S. stock market higher on Wednesday.

Apple Inc (AAPL.O) led the Nasdaq to a 1 percent gain. Shares of the maker of iPhones and iPads surged to a record, making it the most valuable U.S. company in terms of market capitalization. Apple finished up 6.2 percent at $446.66.

Buying picked up after the Federal Reserve said it would keep interest rates near zero through at least 2014, which was longer than many investors anticipated. The actions were taken as a sign of the central bank's commitment to boost a sluggish economic recovery.

"What caught the market off guard was obviously the fact they are going to keep rates lower for longer," said John Canally, investment strategist at LPL Financial in Boston.

"This statement (on an inflation target) moves the ball slightly down the field" for possible more quantitative easing later, Canally said, referring to a type of monetary stimulus.

The Fed also took an historic step of setting an inflation target of 2 percent, which brings the U.S. central bank in line with many of the world's other central banks that use an explicit benchmark for policy.

Apple was a standout in what has otherwise been a fairly lackluster earnings season. So far, 57 percent of companies reporting have beaten forecasts, while at this stage in past earnings seasons, the beat rate averaged 70 percent.

Apple shares hit an all-time high of $454.45 on results issued after Tuesday's market close that sailed past expectations. The move higher pushed Apple's market capitalization above that of Exxon Mobil (XOM.N), making it the largest publicly held U.S. company.

The Dow Jones industrial average (.DJI) rose 83.10 points, or 0.66 percent, at 12,758.85. The Standard & Poor's 500 Index (.SPX) was up 11.41 points, or 0.87 percent, at 1,326.06. The Nasdaq Composite Index (.IXIC) ended up 31.67 points, or 1.14 percent, at 2,818.31.

In other earnings news, video rental company Netflix Inc (NFLX.O) reported results that outpaced Wall Street's expectations, sending shares up about 13 percent to $107.28 in extended trade.

Earlier in regular trading session, both United Technologies Corp (UTX.N) and Rockwell Automation Inc (ROK.N) shares fell after slightly missing revenue forecasts.

United Tech shares closed down 0.2 percent at $77.65 and Rockwell dropped 2.9 percent to $79.42.

Another diversified manufacturer, Textron Inc (TXT.N), surged 14.6 percent to $24.76 after it raised its 2012 profit forecast. The S&P industrials index (.GSPI) gained 1.2 percent.

Corning Inc (GLW.N) tumbled 10.7 percent to $13.05 as manufacturers cut back on the production of big-screen televisions that use the company's specialty glass.

Greece was hoping to reach a deal with its bondholders as talks were set to resume this week to avoid a messy default. Such an outcome could threaten the stability of other debt-laden members of the euro zone as well as the global economy.

About 7.9 billion shares changed hands on the New York Stock Exchange, NYSE Amex and Nasdaq, compared with this year's average of about 6.7 billion shares.

On the NYSE, advancing stocks beat declining ones by ratio of 3-to-1. On the Nasdaq, advancers beat decliners by a ratio of 2-to-1.

Marine pleads guilty, ending final Haditha trial (Reuters)

LOS ANGELES (Reuters) ? The U.S. Marine sergeant accused of leading a massacre of 24 Iraqi civilians in Haditha pleaded guilty on Monday to dereliction of duty, ending the final prosecution stemming from a 2005 incident that brought international condemnation of U.S. troops.

Staff Sergeant Frank Wuterich, 31, entered his plea at Camp Pendleton Marine Corps base north of San Diego as part of a deal with military prosecutors in which more serious charges of involuntary manslaughter and aggravated assault were dismissed.

As part of his guilty plea, Wuterich accepted responsibility for providing negligent verbal instructions to the Marines under his command when he told them to "shoot first and ask questions later," resulting in the death of innocent civilians.

He faces a maximum sentence of three months of confinement, forfeiture of two-thirds of his pay for three months and a reduction in rank when he is sentenced on Tuesday, a Camp Pendleton spokesman said.

"By pleading guilty to this charge, Staff Sergeant Wuterich has accepted responsibility for his actions," base spokesman Lieutentant Colonel Joseph Kloppel said.

Any discharge process Wuterich may face will be separate from the plea and sentencing, Kloppel added.

Wuterich, 31, was accused of being the ringleader in a series of November 19, 2005, shooting and grenade attacks that left two dozen civilians dead in Haditha, a city west of Baghdad that was a hotbed of insurgent activity.

The killings were portrayed by Iraqi witnesses as a massacre of unarmed civilians.

Local witnesses said angry Marines had killed unarmed men, women and children after a popular comrade, Lance Corporal Miguel "TJ" Terrazas, was killed by a roadside bomb.

'CAULDRON OF WAR'

Lawyers for the troops involved argued the deaths resulted from a fast-moving situation in which the Marines believed they were under enemy fire.

Six of the eight Marines originally accused in the case had their charges dismissed by military judges, and a seventh was cleared of criminal wrongdoing.

Wuterich was originally charged with murder in the case.

"No one denies that the consequences of November 19, 2005 were tragic, least of all Staff Sgt. Frank Wuterich," his civilian defense attorney, Neal Puckett, said in a statement released shortly after the plea hearing.

"But the fact of the matter is that he has now been totally exonerated of the homicide charges brought against him by the government and the media. For six years he has had his name dragged through the mud. Today, we hope, is the beginning of his redemption," the statement said.

Wuterich pleaded not guilty when the court-martial began in early January.

The proceedings were suspended last Wednesday by the military judge in the case, who ordered prosecutors and defense lawyers to seek a negotiated plea deal.

The trial resumed on Friday for one day, and the plea agreement was announced on Monday morning.

"Many pundits from all walks of life will comment on Wuterich's purported guilt and most of these are people who have never been remotely associated with the challenges of combat action," Colonel Willard Buhl, a U.S. Marine Corps military fellow at the Council on Foreign Relations, told Reuters.

"Marines know that they are the best trained and led military men and women in the world," Buhl said. "But the cauldron of war is the most intense thing humans can experience and this case falls on the extreme end of that spectrum."

Buhl served in the same battalion and regiment as Wuterich, but never met him and was deployed in that unit before the events at Haditha that are at the center of the case.

Wuterich enlisted in the Marines after his 1998 high school graduation. He was serving his second tour of duty in Iraq when the Haditha incident occurred.
